Terms of Service

The terms and conditions governing your use of GestaltPath. Please read these carefully before using our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and GestaltPath ("we," "us," or "our") governing your access to and use of the GestaltPath mobile application, website at gestaltpath.com, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Service.

If you are using the Service on behalf of an organization (such as a speech-language pathology practice), you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

The Service is intended for use by adults (age 18 or older) who are parents, caregivers, or licensed speech-language pathologists (SPs). By using the Service, you represent that you are at least 18 years of age.

Children do not create accounts or interact with the Service directly. All child-related data is entered and managed by the parent, caregiver, or SP on behalf of the child.

If you are an SP using team features, you represent that you hold valid, current professional licensure or certification in your jurisdiction and that your use of the Service complies with applicable professional standards and regulations.

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account by providing a valid email address. Authentication is performed via one-time password (OTP) sent to your email. You do not create or store a traditional password with GestaltPath.

3.2 Account Security

You are responsible for maintaining access to the email address associated with your account and for all activity that occurs under your account. You agree to notify us immediately at support@gestaltpath.com if you believe your account has been compromised.

3.3 Account Accuracy

You agree to provide accurate and current information when creating your account and child profiles. You are responsible for keeping this information up to date.

3.4 One Account Per Person

Each individual may maintain only one personal account. Creating multiple accounts to circumvent restrictions, abuse free trial periods, or for any other purpose is prohibited.

4. Service Description

GestaltPath is an AI-powered language companion designed for parents and caregivers of gestalt language processors. The Service provides the following core features:

  • Quick Language Logger — Log utterances via text entry or voice recording, with automatic AI classification into Natural Language Acquisition (NLA) stages
  • Live Practice Mode — Real-time coached practice sessions with transcription and post-session summaries
  • Gestalt Library — Save, categorize, and organize identified gestalts for reference and practice
  • Daily Coaching Prompts — AI-generated activity suggestions tailored to the child's current NLA stage and recent utterance history
  • Progress Dashboard — Visual tracking of stage distribution, trends, and milestones over time
  • Team Management — SP-only feature enabling collaborative caseload management through the website

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

5. Subscriptions & Billing

5.1 Plans

GestaltPath offers multiple subscription tiers (e.g., Free, Plus, Pro, Enterprise). Feature availability varies by plan. Current plan details and pricing are available on our pricing page.

5.2 Free Trial

We may offer a free trial period for paid plans. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will be notified before any charges are applied.

5.3 Billing & Renewal

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selection). By subscribing, you authorize us to charge your payment method on each renewal date. All fees are quoted in U.S. dollars unless otherwise stated.

5.4 Cancellation

You may cancel your subscription at any time through the app's Settings or by contacting billing@gestaltpath.com. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date. No partial refunds are issued for unused time within a billing period.

5.5 Price Changes

We may change subscription pricing at any time. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after the price change constitutes acceptance of the new pricing.

5.6 Refunds

Refund requests are evaluated on a case-by-case basis. To request a refund, contact billing@gestaltpath.com within 14 days of the charge in question.

6. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You shall not:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Attempt to access, tamper with, or use non-public areas of the Service, our systems, or our providers' systems
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or its AI models
  • Use the Service to develop competing products or services
  • Scrape, crawl, or use automated means to access the Service except through our official APIs
  • Share your account credentials or OTP codes with any other person
  • Upload or transmit any content that is harmful, offensive, harassing, defamatory, or otherwise objectionable
  • Misrepresent your identity, professional credentials, or affiliation
  • Use the Service to store data unrelated to child language development (e.g., using the utterance logger for non-language-related notes)
  • Circumvent any usage limits, access controls, or security measures
Violation consequences: We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, depending on the severity of the violation.

7. User Content

7.1 Ownership

You retain ownership of all content you create, upload, or enter into the Service, including utterance logs, voice recordings, child profiles, gestalt library entries, and clinical notes ("User Content"). GestaltPath does not claim ownership of your User Content.

7.2 License Grant

By using the Service, you grant GestaltPath a limited, non-exclusive, worldwide license to process, store, transmit, and display your User Content solely for the purposes of providing and improving the Service. This license includes the right to send utterance text to AI service providers for NLA classification and coaching generation, as described in our Privacy Policy.

7.3 De-identified Data

You agree that we may use de-identified, aggregated data derived from User Content to improve our AI classification accuracy and the overall Service. This data cannot be traced back to you or your child. You may opt out of this in Settings > Data & Privacy.

7.4 Data Export

You may export your User Content at any time through Settings > Data & Privacy > Export Data. Exported data is provided in JSON and/or CSV format.

7.5 Data Deletion

You may delete individual child profiles or your entire account at any time. Deletion is permanent and cannot be undone. See our Privacy Policy for full details on data retention and deletion.

8. AI Services & Disclaimers

GestaltPath is not a medical device and does not provide medical advice. The AI classifications, coaching prompts, and stage assessments provided by the Service are informational tools designed to support parents and caregivers. They are not a substitute for professional evaluation, diagnosis, or treatment by a licensed speech-language pathologist or other qualified healthcare provider.

8.1 AI Classification Accuracy

GestaltPath uses a three-tier AI classification cascade to analyze utterances and assign NLA stages. While we strive for high accuracy, AI classifications are probabilistic and may contain errors. You should always apply your own judgment and, when in doubt, consult a qualified speech-language pathologist.

8.2 Coaching Content

Daily coaching prompts and practice session guidance are generated by AI based on the child's utterance history and current stage. These suggestions are general in nature and may not be appropriate for every child or situation. Always consider your child's individual needs and consult a professional for personalized guidance.

8.3 No Professional Relationship

Use of the Service does not create a therapist-client, doctor-patient, or any other professional relationship between you and GestaltPath. The Service is a tool, not a provider of clinical services.

8.4 User Override

You have the ability to review and override any AI classification. We encourage users to actively review AI results and correct them when necessary. User overrides contribute to a more accurate experience over time.

9. Team Features

9.1 Team Management

The team feature allows a speech-language pathologist (SP) to create one team per account and add other SPs and client profiles (CLs) for collaborative caseload management. Team management is performed exclusively through the GestaltPath website.

9.2 Team Owner Responsibilities

As a team owner, you are responsible for:

  • Ensuring that all SPs added to your team are authorized to access the client data shared within the team
  • Promptly deactivating or removing SPs who should no longer have access
  • Complying with all applicable privacy laws, professional regulations, and ethical obligations regarding shared client data
  • Maintaining accurate team membership records

9.3 SP Member Obligations

As a team member, you agree to:

  • Access client data only for legitimate clinical purposes
  • Not share, export, or disclose team client data to unauthorized parties
  • Comply with all applicable HIPAA, FERPA, and other privacy regulations as they apply to your practice
  • Notify the team owner if you believe data has been accessed or shared inappropriately

9.4 Parent Awareness

Team features are SP-side only. Parents and caregivers are not currently notified when a child profile is added to a team. By using the Service as a parent, you acknowledge that licensed SPs using GestaltPath may be granted access to your child's data through the team feature for clinical purposes.

10. Intellectual Property

10.1 Our IP

The Service, including its design, features, code, AI models, algorithms, graphics, logos, the "Pebble Trail" logo mark, the "Ocean to Shore" color palette, and all other visual and technical elements, are owned by or licensed to GestaltPath and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10.2 NLA Framework

GestaltPath's clinical methodology is based on the Natural Language Acquisition (NLA) framework developed by Marge Blanc. We acknowledge and respect the intellectual contributions of the NLA research community. GestaltPath's implementation of NLA stage classification is our proprietary interpretation and does not imply endorsement by the original researchers.

10.3 Feedback

If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant GestaltPath a perpetual, irrevocable, non-exclusive, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation to you.

11. Privacy

Your privacy and the privacy of the children whose data is processed through the Service are of paramount importance to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of data as described in the Privacy Policy, including the processing of utterance data through third-party AI providers for classification purposes.

We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information directly from children under 13. All child data is provided by and managed by the parent or caregiver.

12. Termination

12.1 Termination by You

You may terminate your account at any time by using the account deletion feature in Settings > Data & Privacy > Delete Account, or by contacting support@gestaltpath.com. Upon deletion, all your User Content will be permanently removed in accordance with our Privacy Policy.

12.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms or any applicable law
  • Your use of the Service poses a risk to other users, our systems, or third parties
  • Your account has been inactive for more than 12 consecutive months
  • We are required to do so by law or regulation

Where feasible, we will provide notice and an opportunity to export your data before termination. In cases of serious violations, we may terminate access immediately without notice.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. If you are a team owner, your team will be archived and all team SPs will lose access to team client data. Provisions of these Terms that by their nature should survive termination (including Sections 7, 10, 13, 14, 15, and 16) will survive.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, GESTALTPATH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI CLASSIFICATIONS, NLA STAGE ASSIGNMENTS, OR COACHING CONTENT
  • ANY WARRANTY THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS

You acknowledge that AI-generated content may contain inaccuracies and that you bear sole responsibility for decisions made based on information provided by the Service.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GESTALTPATH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM:

  • Your use of or inability to use the Service
  • Inaccurate AI classifications, coaching suggestions, or stage assessments
  • Unauthorized access to your account or User Content
  • Actions or omissions of other users, including team members
  • Service interruptions, data loss, or system failures

IN NO EVENT SHALL GESTALTPATH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GESTALTPATH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless GestaltPath and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service or violation of these Terms
  • Your User Content or any data you enter into the Service
  • Your violation of any applicable law, regulation, or third-party right
  • As a team owner, any unauthorized access to client data resulting from your failure to properly manage team membership

16. Dispute Resolution

16.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@gestaltpath.com and attempt to resolve any dispute informally for at least 30 days.

16.2 Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in [State], United States, and may be conducted remotely.

16.3 Class Action Waiver

YOU AND GESTALTPATH AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. NEITHER PARTY MAY PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.

16.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

16.5 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of [State], without regard to conflict of law principles.

17. Changes to Terms

We may revise these Terms from time to time. When we make material changes:

  • We will update the "Last Updated" date at the top of this page
  • We will notify you via email or in-app notification at least 30 days before material changes take effect
  • For changes that materially reduce your rights or increase your obligations, continued use of the Service after the effective date constitutes acceptance

If you do not agree with any changes to these Terms, you must stop using the Service and delete your account before the changes take effect.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GestaltPath regarding the Service and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.

18.5 Force Majeure

GestaltPath shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, government actions, Internet or telecommunications failures, or third-party service provider outages.

18.6 Notices

We may provide notices to you via email to the address associated with your account, through in-app notifications, or by posting on the Service. You may send notices to us at legal@gestaltpath.com.
